Background Information
In Nigeria, a bill passes through a series of stages to become law. Below is the list of 6 major stages for brevity and clarity.
1. First reading: The bill is introduced to the House, usually by the Clerk of the Senate or House.
2. Second reading: The bill's content and purpose are debated, and amendments are proposed.
3. Committee stage:
- The bill is studied in detail by a committee,
- which may also hold public hearings
- The committee may also suggest amendments.
4. Third reading: The bill is debated clause by clause, and no further amendments are allowed.
5. Harmonization: If there are differences between the Senate and the House of Representatives, a Conference Committee is formed to reconcile the differences.
6. Presidential assent: The President has 30 days to sign the bill.
(Assent by the Governor: If the bill is for a state, it is assented to by the Governor.)
Bills can originate from:
- citizens,
- the legislature, or
- the executive arm.
Nigeria's National Assembly, which is made up of the Senate and the House of Representatives, is the primary law-making body in the country.
Public Hearing is at third Stage
Based on the above, the calls for public hearing on a bill comes at third stage: Committee Stage
Calling for public hearing before being brought to NASS as proposed by some Senators is either due to Malicious and counter-productivities of some Legislatures or an errant display of ignorance - which call for training or retraining of some Legislatures.
Senator Countering Anti-due-process
Senator Mongunu countered Ndume’s suggestion to withdraw the bills for further consultation.
He said, “The legislative process is clear. At the public hearing stage, all stakeholders, including governors and traditional rulers, can present their views. This process ensures transparency and thorough examination of the bills.”
The Senate President said:
“The bill has been passed for second reading, it will be now transmitted to the Committee for Public Hearing."
“In the course of the public hearing, Nigerians of all walks of life, of all groups, will come and aggregate, including the governors and traditional rulers, the Governors Forum are free to come and ventilate their opinion as to the pros and the cons of the bill."
“After the public hearing, our committee will now look at the various submissions aggregated and then bring it for clause-by-clause consideration."
“These bills are now referred to the Committee on Finance to be referred to the Senate in six weeks.”
When Akpabio put the bills to a voice vote, the majority of the lawmakers shouted, “Aye” and the Senate President hit the gavel in affirmation.
Analysis
- Some Elected Legislatures don't understand the bill passing process
- Some know the process but deliberately act counter-productive for selfish reasons.
Recommendations and Conclusions
