Supreme Court Affirms Constitutionality of EFCC ICPC and NFIU


16 States Call for Eradication of EFCC, ICPC & NFIU - But the Supreme Court Dismisses State Challenge & Affirms Their Constitutionality

the Supreme Court of Nigeria has dismissed a suit filed by 16 states challenging the constitutionality of the:

  1.  Economic and Financial Crimes Commission (EFCC), 
  2. Independent Corrupt Practices and other related offences Commission (ICPC) and the
  3. Nigerian Financial Intelligence Unit (NFIU)

The states argued that these agencies were established based on a UN convention and not in accordance with the Nigerian Constitution

However, the court ruled that the EFCC Act does not require ratification by state assemblies and dismissed the suit for lacking merit.

Review of Anti-Progressive Actions by Nigerian State Governments


  1. 16 state governments sought the eradication of the EFCC and ICPC to perpetuate corruption. They lost at the Supreme Court on 15 September 2024.
  2. These states opposed local government autonomy but were defeated by the Supreme Court on 11 July 2024. 
  3. They are currently challenging new tax reforms, and Nigerians eagerly await the outcome.

Conclusion

The PBAT administration is triumphing over corruption in Nigeria. For decades, Nigerians have yearned for a government with the courage to tackle corruption, and now we have one in PBAT.
